A woman has fought her way through to get her fine dropped after police mistook her ice cream for a mobile phone while she was driving.
Michelle Course, from?Melbourne, Australia, was pulled over by cops after they allegedly spotted her using her mobile while driving in November 2020, 9News reported.?
After being stopped, Course was charged with driving while using her phone and fined almost $500 (Rs 38,000) for the offence.??
But it wasn't the case. Course wasn't using her mobile, and was instead holding her Magnum ice cream - and soon produced its wrapper and a receipt, showing she bought it just six minutes before she was stopped by police.? ?
Although she wasn't keen on taking her fine to court she decided she needed to defend herself as she had done nothing wrong, and soon produced phone records to prove she never used the device.??
Speaking to?A Current Affair?about the incident last year, Course said: "There's no way I could be eating my Magnum Ego, holding my phone and driving at the same time."??
Despite showing the officer the evidence, though, the fine still stood and she was ordered to pay $496 (Rs 37,700).
However, she wasn't going to pay for the deed she didn't do.?
She contacted Victoria Police to enquire about getting access to the dashcam footage from the day she was pulled over as well as asking the police to look up her phone records to determine whether or not she was making a call at the time.
And it paid, with police finally dropping the case
"Common sense has prevailed and the fine has been dropped,"?Course told?A Current Affair.?
"I was contacted a few days before the court date and I was very grateful that the system had worked and that justice had come about," she added.??
