Atul Subhash suicide: Karnataka High Court rejects Nikita Singhania's plea to cancel FIR
Nikita Singhania's lawyer told the court that no ingredients were made out in the complaint for the registration of the FIR over the abetment of suicide. According to her lawyer, Atul Subhash had not mentioned any act by Singhania and her family members that drove him to die by suicide.
The Karnataka High Court on Monday questioned why Nikita Singhania, the estranged wife of Atul Subhash, the Bengaluru techie who died by suicide last month, did not want a probe into the death. The single bench of Justice SR Krishna Kumar raised the question while rejecting the plea by Singhania seeking to cancel the FIR registered against her and her family in connection with the case.
'Nikita Singhania has right to seek legal remedies'
Singhania's lawyer told the court that no ingredients were made out in the complaint for the registration of the FIR over the abetment of suicide.
According to her lawyer, Atul Subhash had not mentioned any act by Singhania and her family members that drove him to die by suicide.
Singhania's lawyer further argued that she had the right to seek legal remedies and couldn't be booked just for lodging a complaint against Atul Subhash.
'Why don't you want investigation'
However, the court on Monday rejected the plea and asked: "The prima facie ingredients of the offence are made out in the complaint. Why don't you want the investigation to happen?"
Nikita Singhania, family granted bail
The development comes days after Singhania, her mother, and her brother, who were arrested on 15 December on charges of abetment of suicide, were granted bail by a court in Bengaluru.

Atul Subhash's father expresses concern over grandson
Responding to the trio being granted bail, Pawan Kumar Modi, the father of Atul Subhash, expressed concern over the safety of his grandson.
"I am really worried about my grandson and where he is. We have received information from the Karnataka Police about our grandson, that he is in a boarding school in Faridabad... he has been admitted to the school at a very young age, which is illegal," he said.
Atul Subhash's father further alleged that Singhania was using her son to get bail.
"The mother has no love for her child. She is just using him as an ATM to extort money. The mother used the child as a reason to apply for her bail. She has done this before as well," he alleged.
