The Delhi High Court has imposed a fine of Rs 1 lakh on a man claiming to be a member of an erstwhile royal family and initiated legal proceedings to stake ownership of the land between the rivers Ganga and Yamuna.
The complainant, Kunwar Mahender Dhwaj Prasad Singh had filed a plea in the HC claiming that the land between the two rivers spread Agra, Meerut, Aligarh, and 65 revenue estates spanning Delhi, Gurgaon, and Uttarakhand belonged to him.
Who is Kunwar Mahender Dhwaj Prasad Singh
Singh claimed that he is the only surviving son of Raja Thakur Mat Matang Dhwaj Prasad Singh.
This, according to Singh makes him the present Ruler of the Beswan Avibhajya Rajya which still holds the status of a Princely State.
He further argued that the Beswan family holds the territories of the United Provinces of Agra running between river Yamuna and Ganga from Agra to Meerut, Aligarh, Bulandshahar and other territories.
What were his demands
He also sought a direction on the Union Government not to conduct election for Lok Sabha, Rajya Sabha, Assemblies, Local Bodies within the territories claimed by him, without following the due process of law for merger.
Why come to us now?
On Thursday an HC Bench of Acting Chief Justice Manmohan and Justice Manmeet PS Arora said that Singh cannot agitate his claim in writ proceedings, that too after so many years of Independence.
¡°You say you own the entire area between Yamuna and Ganga. On what basis you're coming? After 75 years you have woken up,¡± the bench remarked.
What Delhi HC said
¡°The grievance arose in 1947¡. Isn't it too late in the day to contest this? This is 1947 and we are in 2024. Many years have gone by. Whether you're the raja or not, we don't know. You can't complain today that you've been deprived in 1947,¡± it added.
¡°The Court had held that the petition was completely misconceived, an abuse of process of law and a complete waste of judicial time,¡± the HC said while dismissing the plea.
