UP Family Court Orders Woman To Pay Maintenance Allowance To Husband With No Income
The woman and the husband have been living separately for many years. The man had filed a petition in 2013 under the Hindu Marriage Act, 1955, seeking maintenance allowance from his wife.
In a rather fair case from Uttar Pradesh, a family court in UP has ordered for a woman to pay her husband, with whom she separated years ago, a sum of Rs 2000 every month.
62-year-old Kishori Lal Shankar does not have a permanent source of income.
The UP court-ordered Munni Devi, who recently retired from the Army, to pay monthly alimony of Rs 2,000 to her ex-husband.
Kishori Lal Sohankar runs a tea stall in Khatauli town of Muzaffarnagar and his former wife, who worked in the Indian Army, gets Rs 12,000 as a pension.
A petition that was filed by the estranged husband back in 2013, considering they have been living separately for years now, sought for a monthly allowance from his wife under the Hindu Marriage Act, 1955.

However, since the cases of women paying alimony to their estranged husbands are rare in the country, it took them a while to convince the court to direct Munni Devi to pay monthly alimony to Sohankar.
Since the wife here was employed with the government and getting a fixed monthly pension, the law saw her in a position to continue to pay for her husband¡¯s maintenance and thereby approved his petition for a monthly allowance.

The woman and the husband have been living separately for many years. They parted ways in 2013, about 23 years after tying the knot. Their son lives with his mother in Kanpur.
