Aryan Khan Moves Bombay HC To Modify Bail Terms, Seeks Relief From Weekly Attendance At NCB

Bollywood superstar Shah Rukh Khan¡¯s son Aryan Khan has moved to the Bombay High Court seeking modification in his bail conditions.
Khan, released on bail after a month of police custody in the cruise ship drug bust case, was granted bail by the Delhi High Court on 14 conditions.
One of the 14 conditions for Aryan includes a mandatory appearance before the Narcotics Control Bureau (NCB) every Friday.
In an interim application, Aryan stated that since the probe in the case has been transferred to the Special Investigation Team, Delhi office of NCB, his visits to the Mumbai office could be relaxed.
His application adds that now that NCB isn't interrogating him, his attendance may not be required every Friday.
Following the court¡®s direction, Aryan made his mandatory visits to the NCB¡¯s Mumbai office on November 5, 12, 19 and 26 and December 3 and 10.
In his application, Aryan added that every Friday, when he visits the agency¡¯s office in Mumbai, he is escorted by police officials due to many media personnel outside the NCB office.
Aryan added he will always cooperate when summoned and has ¡°firm roots in society¡±.
Here's a summary of points based on which Aryan seeks exemption:
1. He assiduously and scrupulously complied with all bail conditions mentioned.
2. He visited the NCB office every Friday as was directed by the High Court in the order stating conditions. He visited the office on November 5, 12, 19, 26 and 3 and 10, 2021.
3. He responded to the summons of the Special Investigation Team, NCB New Delhi, by visiting the Kharghar office of the NCB Mumbai zonal unit.
4. No further statement was recorded since November 12 after the Special Investigation Team, NCB New Delhi, took over the case.
5. There is no likelihood for the Mumbai office to interrogate him, and as a consequence, no point in his attendance at their office every Friday.
6. He has been followed by many media personnel, extensively photographed and questioned while visiting the NCB office.
7. To maintain a law and order situation, many police officials are deployed. However, if the bail condition is relaxed, that can be dispensed with.
8. Grounds for parity with co-accused Manish Rajgadiya whose weekly presence was dispensed.
9. He will appear as and when summoned.
10. He is a student from a reputed family and wants to lead an honourable and dignified life.
The High Court is likely to hear the application next week.
On October 28, three of the accused, Aryan, Arbaaz Merchant and Munmun Dhamecha, were released by the court on bail upon executing personal bonds of Rs 1 lakh each with one or more sureties in the like amount.
