You Don't Deserve Sympathy, Better Enjoy Being In Jail: SC Tells Former CMD Of Amrapali Group

The Supreme Court on Friday rejected the bail plea of former CMD of Amrapali Group of Companies Anil Kumar Sharma and said that he did not deserve any sympathy.

"You have cheated thousands of home buyers. You siphoned off their hard-earned money and their life savings. You do not deserve any sympathy," a bench comprising Justices Ajay Rastogi and Bela M Trivedi said.
¡°Yours is not a case of simple cheating. See the plight of thousands of home buyers. You cannot have our sympathy. You better enjoy being in jail... This court is very aware of what you did. You created the mess and we are not able to find a way out of it. A large number of home buyers are suffering," the bench said further.
Amrapali accused of syphoning off customer money
The former CMD of the real estate group and other directors of the firm were arrested at the top court's direction after the forensic audit report revealed that the management siphoned off a large amount of home buyers' money.
The apex court, in its July 23, 2019 verdict, had cracked down on errant builders for breaching the trust reposed by home buyers and ordered the cancellation of registration of the Amrapali Group under real estate law RERA and ousted it from prime properties in the national capital region (NCR) by nixing the land leases.
The top court had directed a probe by the Enforcement Directorate (ED) into alleged money laundering by realtors, providing relief to over 42,000 home buyers of the Amrapali Group with the verdict.
Sharma booked for murder
Besides the cheating case, Sharma is also accused of murder over the death of one Dr Sharad Chandra, who was shot dead in Bihar in 2014.
It is alleged that Dr Chandra, who was the then secretary of Balika Vidyapeeth in Lakhisarai, was shot dead in August 2014 to take over the land and assets belonging to the educational institution. Chandra was removed from his post after Anil Sharma, with the help of some others, seized the land and assets of the institution.
In January this year, the CBI said that Anil Sharma had usurped the trust of Balika Vidyapeeth with the help of Rajendra Prasad Singhania, Dr Praveen Kumar Sinha, Shyam Sunder Prasad, and Shambhu Sharan Singh.
"Sharad Chandra was targeted before his death as well as he had raised questions regarding the functioning of the school under the new trust. He had been threatened, attacked, shot at, and even his house was damaged for questioning the trust," the agency added.
