One couple wishes to get married under the Special Marriage Act while the other wants to register their wedding in USA under the Foreign Marriage Act, as per a report in PTI.
Justices R S Endlaw and Asha Menon issued a notice to both the centre and the Delhi government to know their stand on the plea of two women wanting to get married.
The court also sent a notice to the Centre and the Consulate General of India in New York regarding the plea by two men who married USA but could not register under the FMA.
Both matters shall have a hearing on January 8, 2021.
Homosexuality has been decriminalised in India. In 2018, consensual gay sex was legalised. Way back from 1861, Section 377 made sexual activities "against the order of nature" punishable by law and carried a life sentence.
