The draft Surrogacy Bill (2016) aims to regulate how surrogacy is commissioned in India.

Official sources have revealed that the Bill is now on its way to Parliament for a final approval, after being cleared by a Group of Ministers that the PMO had referred.

The new law will permit only married Indian couples to have children through 'altruistic' surrogacy, ending the possibility of buying a womb. External Affairs Minister Sushma Swaraj said that the legislation will ban the business of commercial surrogacy.

Further, it bans live-in and homosexual couples, as well as single parents from surrogacy.
"Wombs of poor women are being bought even by celebrities who have one or two children. This is unethical," she said.

To prevent exploitation of women, especially those in rural and tribal areas, the government has prohibited foreigners from commissioning surrogacy in the country and has drafted this comprehensive legislation, the sources said. The government had recently said in Parliament that provisions are being made in the draft Bill to make parentage of children born out of surrogacy "legal and transparent".
