'March With Time', SC Tells Coast Guard On Permanent Commission For Women Officers
The Supreme Court has told the Indian Coast Guard to note ¡®the march of time¡¯ and grant permanent commissions to women short service appointment (SSA) officers. The bench headed by Chief Justice of India (CJI) DY Chandrachud made the observation on Monday.
The Supreme Court has told the Indian Coast Guard to note ¡°the march of time¡± and grant permanent commissions to women short service appointment (SSA) officers like in the Army, Navy and Air Force.
The bench headed by Chief Justice of India (CJI) DY Chandrachud made the observation on Monday while hearing the plea by Priyanka Tyagi who was discharged by the Coast Guard in December 2023 after 14 years of service.
If Army, Navy and Airforce can
The SC ordered her to be reinstated as an interim measure till it decided on the plea for parity with her male counterparts.
¡°Look at your resistance to having a single woman in the Coast Guard. This was the same resistance Cornelia Sorabjee (first female advocate in India) put up when she was told you are not good enough. When women came into the Army and Air Force, they were told you are not good enough. And in the Navy, they were told we do not have toilets for you. See the march of time,¡± the SC said.
Coast Guard cannot remain an outlier
The bench said when different branches of armed forces have granted PC to women short service commission officer, ICG cannot remain an outlier.
¡°As regards Army, Navy and Air Force, this court has already rendered judgments. Unfortunately, the Indian Coast Guard continues to be an outlier,¡± it said.
"The petition needs to be heard given the broader constitutional mandate of Article 15 (prohibition of discrimination on grounds of religion, race, caste, sex or place of birth)," it said.
If you don't, we will do it
In February, the SC had instructed the Centre to consider the issue of granting permanent commission to women Coast Guard officers, stating that "women cannot be left out" and warning that "if you do not do it, we will."
Earlier, the apex court reprimanded the Centre for adopting a "patriarchal" stance on the issue of granting permanent commission to women in the Coast Guard.
