Lawsuit Accuses TCS Of Pushing Out American Workers, Favouring H-1B Visa Holders

A former Tata Consultancy Services (TCS) executive in the US has filed a lawsuit against his former employer accusing the Indian IT company of pushing out older American workers to make way for foreign workers on H-1B visas.
Who is Randy Devorin
Randy Devorin, who has over 30 years of experience in the tech industry has accused TCS of terminating older White workers in favor of thousands of recent graduates on temporary work visas.
According to his LinkedIn profile, Devorin was the Regional Manager of Program Management Division at Tata Consultancy Services till late last year.
Devorin who was with TCS for more than ten years was let go last year during a layoff round.
What is his complaint
Earlier this week, Devorin filed a lawsuit against TCS in the US accusing the company of violating the Age Discrimination in Employment Act as well as Section 1981 of the 1866 Civil Rights Act. The lawsuit seeks unspecified damages and attorney¡¯s fees.
¡°Based on Mr. Devorin¡¯s discussions with colleagues, the layoff appears to have targeted non-Indians who were over 40 years of age,¡± according to the complaint in the US District Court for the Southern District of Florida.
The lawsuit also cites public comments from TCS Chief Operating Officer N Ganapathy Subramaniam about plans to hire 40,000 recent college grads this year.
Similar allegations against TCS
Earlier, at least 22 American workers had filed complaints against TCS with the US Equal Employment Opportunity Commission since December alleging race and age-based discrimination in favor of Indian workers on temporary visas.
H-1B Visa
The H-1B visa is a non-immigrant visa that allows U.S. companies to employ graduate-level workers in specialty occupations that require theoretical or technical expertise in specialized fields.
Indian tech companies including TCS, Infosys, and Wipro are among the largest users of the H-1B visa programme, which allows them to send Indian workers to the US at a payscale much lesser than what they have to pay an American for the same job.
