After Husband Refuses To Disclose His Salary, Wife Uses RTI To Get His Income Details
A woman named Sanju Gupta filed an RTI application to know the details of her husband¡¯s gross income for the financial years 2018-19 and 2019-20.
Disappointed by her husband's discretion over his salary details, a wife found a perfect way to get all the answers. According to the Central Information Commission (CIC), a wife can use the Right to Information Act to obtain information about her husband's income.
The appellate body recently ordered the Income Tax Department to provide a woman with generic information about her husband's net income. The Financial Express acquired details about the case, which seems connected to a marital conflict.
A report in Financial Express claims that Sanju Gupta had filed an RTI application to know the details of her husband¡¯s gross income for the financial years 2018-19 and 2019-20.
Gupta also inquired about her husband's taxable income.
However, the Central Public Information Officer (CPIO) at the Income Tax Department office in Bareilly initially declined to provide her with the details, citing her husband's refusal to share the mentioned details.
Gupta filed two more appeals after being unsatisfied with the first attempt. She started by seeking assistance from the First Appellate Authority (FAA), which upheld the CPIO's order.
Gupta, unfazed, filed a second appeal with the Central Information Commission (CIC).
According to the FE report, "the CIC looked into some of its past orders and judgments of the Supreme Court and High Courts."
After considering these factors, the CIC ruled in favor of the wife and directed the CPIO to "inform the appellant about the generic details of the net taxable income/gross income of her husband held and available with the Public Authority."
