Florida Man Might Get 30 Years In Jail After Argument Over Key Lime Pie With Brother
The man, identified as David Sherman Powelson, was taken into custody on Wednesday, and as bizarre as it sounds, he was charged with first-degree felony aggravated battery, according to court records reviewed by Law & Crime.
This charge has led to the old man facing decades in jail, as under Florida state law, any individual convicted of a first-degree felony faces up to three decades in jail. Moreover, if the person accused is over 65, they face a minimum jail time of three years.
The cops showed up at their residence at night when a complaint for a "physical domestic dispute" was lodged. According to the reports, a deputy reached the house and made contact with the older brother, who is referred to as the "victim" in the official files. The Argument Began When The Older Brother Noticed David Had Eaten The Key Lime Pie He Was 'Saving'
The brother complained that he was lounging in his chair when he noticed that his younger brother had eaten the key lime pie he was "saving." This launched an argument between the two. "While sitting in the chair, David [Powelson] emptied two large glasses of water on the victim. The victim feared [Powelson¡¯s] aggressive behavior would lead to him being physically harmed and or killed," read the affidavit.
David then explained to the deputy that his brother had left the pie in the fridge for several days, so he simply ate it. When the argument rose to a pitch, David admitted that he had poured a glass of water on his brother to "calm him down" and then poured another.
According to state law, the charge of battery is raised to aggravated battery when the accused "intentionally or knowingly causes great bodily harm, permanent disability, or permanent disfigurement."
