In several cases of late, courts across the country have stated that an act of consensual sex between a couple in a relationship cannot be termed as rape after they break up.
Courts have also noted that educated women in a premarital relationship cannot claim rape after the relationship breaks even if the consensual sex was on the promise of marriage.

In yet another case, the Karnataka High Court has granted bail to a youth accused in a rape case by his former lover.
The 25-year-old from Tumakuru was arrested on charges of rape, in a case filed by his ex-lover. The woman, a 24-year-old school teacher, had met the accused in college and had been in a relationship since 2013.?
According to the woman, the accused had introduced her to his family in 2018 and later on the promise of marriage had sex with her multiple times.

She filed a rape complaint after the youth refused to marry her.
Rejecting the arguments made against the accused, the court observed that, the woman, working as a teacher, was mature enough to be aware of the consequences of a premarital relationship.
