A visit to the dentist is not among the most pleasant experiences one can have. But what if matters are made worse by the Dentist by performing the medical procedure on the wrong tooth?
The District Consumer Forum in Kerala's Kottayam District has ordered a city-based Dentist to pay a compensation of Rs 5 lakh to a patient for damaging her five healthy teeth.
The patient, identified as KR Usha Kumari, a resident of Kottayam had filed a complaint against Dentist Shiny Antony Rauf.
According to the complainant, Kumari had approached Rauf some time ago to find out if there was any gap or fracture in her upper tooth.
However, the dentist, without the patient's permission, performed another dental procedure on five undamaged teeth.
This, Kumari alleged left her in a lot of pain and she even had difficulty in speaking.
Kumari also had to pay an advance amount for crowning the five undamaged teeth to Dr. Rauf.
She was forced to seek treatment at the Kottayam Dental College later and also pay Rs 57,600 at another hospital for fixing the crow.
Kumari approached the Consumer Forum alleging negligence by the Dentist, which resulted in her suffering mental and physical agony.
The Consumer Forum on Tuesday found that negligence in the treatment by the dental surgeon destroyed the healthy teeth of the complainant and caused her mental distress and financial loss. The panel ordered the dentist to pay a compensation of Rs five lakh to the patient.
In a similar case, earlier this month, the Supreme Court awarded a compensation of Rs 2 lakhs to an 84-year-old man from Faridabad who lost vision in his left eye during a medical surgery.
The complainant alleged that he lost vision in his left eye during a surgical procedure conducted in 2002.
The complainant had approached the Faridabad District Consumer Disputes Redressal Commission, which in 2008 ordered the doctors to pay him Rs 2 lakh compensation with interest at 12 per cent p.a.
Earlier this month the SC upheld the verdict and also imposed a cost of Rs 50,000 on the doctor for making a false representation that the amount of compensation had been paid to the complainant.
