The Karnataka High Court came up with a bizarre observation while giving bail to a rape accused. It observed that it's 'unbecoming of an Indian woman to sleep after being raped', as per a TNN report.??
This strange conclusion was reached by Justice Krishna S Dixit when he granted anticipatory bail to the accused Rakesh B.?
According to Bar and Bench report, the judge said," The explanation offered by the complainant that after the perpetration of the act she was tired and fell asleep, is unbecoming of an Indian woman; that is not the way our women react when they are ravished."?
One other factor that favoured bail was because the victim failed to provide an explanation as to why she went to the office at 11 pm and had no objections to taking 'drinks' with the accused on the day the alleged crime took place.?
The accused cannot leave the trial court jurisdiction without taking permission. He also has to report to the police station on the second and fourth Saturdays of each month.?
The accused was the victim's employee for the last 2 years. The accused allegedly developed physical relations with her on the pretext that he would marry her.?
