The Allahabad High Court has granted anticipatory bail to a man accused of raping his daughter-in-law, along with another person saying that it is "quite unnatural" in the Indian culture that a father-in-law commits such a crime.?
The court made the comments on May 18 while hearing a plea filed by one Babu Khan, who was booked under Sections 376 (rape), 511 (punishment for attempting to commit offences punishable with imprisonment for life or another imprisonment), 504 (intentional insult with intent to provoke breach of the peace) and 506 (criminal intimidation) of the Indian Penal Code (IPC).
According to the complaint filed by Khan's daughter-in-law, on March 1, 2018 the accused along with another person came to the house of the victim's brother when she was alone and asked the whereabouts of her brother.
When the woman said that her brother is not at home, Khan started sexually abusing her. According to the FIR registered in the Saharanpur police station, the woman tried to stop him but she was raped by the two men.
Khan moved the court seeking anticipatory bail stating that his co-accused has already been granted the same.
On May 18, the Allahabad HC bench of Justice Ajit Singh granted anticipatory bail to the accused.
"It is quite unnatural that a father-in-law shall commit rape of his daughter-in-law along with other person in our Indian culture," observed the Allahabad High Court while granting the anticipatory bail.
"In the event of the arrest of the applicant, he shall be released on anticipatory bail on his fulfilling certain conditions," the court added.
The court's observation that "it is unnatural in Indian culture" contradicts the data from the National Crime Records Bureau (NCRB).
As many as 26,727 rape cases were reported in the year 2020 from across the country. In which, only 1,185 were committed by persons who were unknown to the rape victims. In the remaining cases, offenders were close to the victims¡¯ family or the victims.
A total of 2,364 rapes were committed by family members and 10,189 were committed by friends/online friends or live-in partners on the pretext of marriage or separated husband. Whereas, 12,989 offences were committed by family friends, neighbours, employer or other known persons.
While these are the number of reported cases, many such crimes go unreported due to pressure on the victim by the family.
