A federal judge has ruled that Elon Musk¡¯s tweets to take Tesla private in 2018 -- the tweets about having secured financing to take the company private -- were false, based on court filings by Tesla investors suing the billionaire over the tweets.?
Reported first by Reuters, as per the filing, the court ruled on April 1st that Musk's four-year-old tweets were false and misleading and that he had recklessly made the statements with knowledge of their falsity.?
Tesla investors in the filing have asked the judge to stop Musk from his ¡°public campaign to present a contradictory and false narrative,¡± regarding his 2018 tweets.?
In 2018, Musk had claimed that the funding had been secured to take Tesla private. He settled with the US securities regulators by paying fines while also agreeing to have a lawyer approve some of his tweets before posting.?
The decision taken on April 1st wasn¡¯t listed on the court docket. The issues will be discussed during a jury trial in May where investors are looking to seek damages over the tweets.?
Alex Spiro, a lawyer for Musk and Tesla asserted once again that it was true that Musk was indeed considering taking Tesla private in 2018 and had the financing in place for it, ¡°All that¡¯s left some half-decade later is random plaintiffs¡¯ lawyer trying to make a buck and other trying to block that truth from coming to light, all to the detriment of free speech.¡±?
