A 62-year-old woman was recently allowed?by the Supreme Court of Western Australia?to?harvest her late husband's sperm?after convincing a judge that the couple had planned to have a child before he died.?
According to judicial documents unsealed Wednesday, the couple began considering having another child after their 31-year-old son was killed in a car accident in 2019.?Their 29-year-old daughter had drowned on a fishing trip six years before that.?
Following these tragic occurrences, the couple began researching whether the 61-year-old husband's sperm might be used to impregnate a surrogate.
After the man died at home on December 17, his wife, who cannot be named for legal reasons, requested that his sperm be collected and stored in the hospital morgue.
According to legal filings, the hospital dragged its feet, causing the woman to seek an urgent order in the Supreme Court of Western Australia.She did so since reproductive tissue reportedly needs to be taken between one and two days following death.?
Judge Fiona Seaward decided that the sperm could be retrieved and stored, but that it would require other court approvals before it could be used for fertilization.The order was issued on December 21, but it was just recently made public.
Although odd, sperm from deceased lovers is not unheard of in Australia. An Australian woman was granted permission in June 2023 to extract sperm from her 29-year-old husband, who allegedly died after slicing an artery on a shattered window pane.??
