They say that a friend in need is a friend indeed. In one such case, a man from Tamil Nadu has approached the Madras High Court to 'rescue' his friend, who he claims is in the illegal custody of his own wife.
The complainant, in a habeas corpus petition before the court, alleged that his friend is detained by his wife and two others who are trying to make him transfer properties in his name to her.
The petitioner said that his friend is being held forcibly in the pretext of treatment for alcohol addiction, though he is not under the influence of alcohol.
Rejecting the allegations, the lawyer representing the wife of the man who is allegedly in detention said that ¡°The wife has to make sure that the detenu comes out of his habits and therefore admitted him to an authorised de-addiction centre in Chennai.¡±?
The lawyer also refuted the allegations of attempts being made to force him to sign the papers by transferring the property.
After hearing the two sides, the division bench of Justice M M Sundresh and Justice D Krishnakunar appointed a lawyer as the Advocate Commissioner to ascertain the facts in the case.
The Court directed that the Advocate Commissioner shall make an enquiry with the third respondent (wife) and the detenu and file a report by Wednesday, before the Court.
The Court has directed that the report would also indicate the statement on enquiry from the De-addiction cum Rehabilitation Center as well and that the report should touch upon the habit of the detenu and his physical condition as well.
