The government is in the process of transforming the labour law framework in India with the introduction of four new labour codes to replace 29 current central labour laws.
According to the new laws on labour, the working hours for a day are 12 hours, while the weekly hours of work are 48 hours. That means that companies or factories can work a full week. The overtime has increased from 50 to 125 hours per quarter across different sectors.
Further, as per the new code, the provisional employee fund will increase while the salary paid in cash will likely decrease. After adopting the code, workers will be able to avail vacation each 180-day instead of 244 days as per the previous rules. In India, the full and final payment is due within 45 days of the end of an organisation.
Over 90% of India¡¯s 50 crore workers are in the unorganised sector. And through these codes the government is aiming to ensure that all of them enjoy the benefits of labour laws related to minimum wages and social security.
